AIM End User License Agreement (EULA)
AIM by Three 21 Creative, LLC
Effective Date: January 1, 2026
This End User License Agreement governs all access to and use of the AIM platform, including all AIM software, systems, dashboards, APIs, data feeds, and related services. By creating an Account, submitting payment, adding a Payment Method, logging into AIM, or using AIM in any capacity, the Account agrees to be bound by this Agreement. If the Account does not agree, it may not use AIM. AIM is owned and operated by Three 21 Creative, LLC, a Florida limited liability company.
Definitions
“Account” means the business entity registering for AIM and its employees, officers, directors, agents, contractors, and authorized users. “Lead” means any inbound contact, call, submission, message, form entry, or data packet delivered, generated, or routed through AIM. “Wallet” means the Account’s prepaid balance used to fund Leads, fees, usage charges, and other amounts owed. “Deposit Balance” means Wallet funds purchased but not yet applied. “AIM Data” includes all system data, logs, analytics, usage activity, metadata, payment records, Lead records, call logs, distribution timestamps, AI training inputs, and outputs created or stored by AIM. “Payment Method” includes any credit card, debit card, bank account, ACH account, or other payment instrument submitted by the Account.
License Grant
AIM grants the Account a limited, revocable, nonexclusive, nontransferable license to access and use AIM solely for lawful business purposes in accordance with this Agreement. AIM retains all intellectual property rights in its platform, software, user interface, algorithms, billing systems, lead-distribution logic, AI systems, data models, and all derivative works.
Ownership of Leads and Data
All Leads delivered through AIM are jointly owned by Three 21 Creative, LLC and the Account. AIM may retain, analyze, annotate, redistribute, reassign, reuse, or repurpose Leads at its discretion. AIM may use Lead Data, AIM Data, Account Data, call logs, message logs, distribution outcomes, metadata, behavioral patterns, and any data processed through AIM to train, refine, enhance, and improve AIM algorithms, optimization engines, predictive models, fraud-detection systems, artificial intelligence systems, machine learning models, LLMs, and any future AIM technologies. AIM retains all intellectual property rights in any models, insights, derivative works, or outputs generated through such processing. AIM is not required to delete training data or model outputs upon Account termination.
Payment Terms and Billing
All usage is deducted from the Wallet. Payments are final and nonrefundable except at AIM’s discretion. By adding a Payment Method, the Account authorizes AIM to store the Payment Method via its PCI-compliant processor and automatically charge it for Wallet reloads, usage-based charges, variable charges, recurring charges, negative balance recovery, and any amounts owed. Charges may occur without prior notice. The Account authorizes AIM and its processor to receive updated card details through card-network updater services and to bill updated credentials. Negative Wallet balances are immediately due and accrue interest at the maximum rate permitted under Florida law if unpaid for thirty days. AIM may charge any Payment Method on file to recover amounts owed. The Account agrees not to dispute or charge back any authorized transaction. Chargebacks constitute a material breach and the Account is responsible for all related fees, penalties, and legal costs. AIM’s billing logs, timestamps, distribution records, and internal system data constitute final and binding evidence of amounts owed. AIM may modify fees or pricing at any time; continued use constitutes acceptance.
ACH Authorization
By providing bank information, the Account authorizes AIM to initiate ACH debits, including variable and recurring debits, for all amounts owed. The Account must maintain sufficient funds and is responsible for all NSF fees, penalties, and return costs. Revocation must be submitted at least three business days before a scheduled debit.
Lead Delivery and Disputes
A Lead is considered delivered once it appears within AIM. The Account has three days to dispute a Lead; after this period, all billing is final. AIM retains sole discretion to determine Lead validity, billability, refund eligibility, or credit adjustments.
Acceptable Use
The Account may not interfere with or manipulate AIM’s systems, billing mechanisms, algorithms, AI models, or distribution logic; circumvent Wallet or fee requirements; scrape, extract, harvest, or copy AIM Data; reverse engineer, decompile, or attempt to obtain AIM source code; access AIM through unauthorized APIs, bots, scripts, or automated tools; share login credentials; permit unauthorized access; or use AIM for unlawful, deceptive, fraudulent, abusive, or noncompliant marketing practices. Any violation constitutes a material breach.
Marketing Compliance Responsibilities
AIM does not obtain consent from Leads for the Account. The Account is solely responsible for compliance with all federal and state marketing laws including the Telephone Consumer Protection Act (TCPA), CAN-SPAM, Do Not Call (DNC) rules, and all laws governing outreach, messaging, and contact attempts. The Account must independently verify consent before calling, texting, or emailing any Lead. AIM makes no representation that Leads contain valid consent or lawful contact information.
No Guarantees Regarding Leads
AIM does not guarantee Lead quality, accuracy, completeness, validity, responsiveness, intent, contactability, or conversion potential. AIM does not guarantee Lead volume, pacing, distribution frequency, availability, or performance. Leads are provided “as received.”
Suspension and Termination
AIM may suspend or terminate access at any time for any reason, including nonpayment, chargebacks, suspected fraud, system abuse, data misuse, or violation of this Agreement. AIM may delete Account data following termination. AIM has no obligation to retain or restore data.
Privacy and Data Use
AIM may collect, store, process, analyze, transmit, and use Personal Data, Account Data, AIM Data, Lead Data, and tracking data to operate and improve AIM; perform billing; verify identity; detect fraud; enforce this Agreement; comply with law; support analytics; train AI models; enhance system performance; and develop new AIM technologies. AIM uses tracking technologies including cookies, pixels, analytics tools, behavioral tracking systems, and advertising technologies such as Google Analytics, Meta Pixel, TikTok Pixel, Hotjar, FullStory, and Segment. AIM may share data with service providers including payment processors, telecommunications partners, infrastructure providers, fraud-prevention systems, analytics vendors, and subcontractors. AIM does not sell Personal Data. AIM retains data for as long as it determines necessary for business or legal purposes. AIM is not responsible for the Account’s compliance with privacy laws governing Leads. Users must be 18 or older. AIM is operated solely in the United States.
Security
AIM uses commercially reasonable safeguards but does not guarantee against unauthorized access, breaches, or failures. The Account is responsible for securing its credentials.
Confidentiality
The Account must maintain the confidentiality of AIM’s algorithms, workflows, financial terms, and proprietary information.
Limitation of Liability
AIM’s liability is limited solely to the specific Lead or Leads that directly give rise to a claim. AIM’s maximum total liability shall be the smallest of the price paid for the Lead, ten thousand dollars ($10,000), or one month of fees paid by the Account in the month preceding the event. AIM is not liable for indirect, incidental, consequential, exemplary, special, or punitive damages, including lost profits, data loss, business interruption, or reputational harm. These limitations apply regardless of legal theory and survive termination.
Third-Party Services
AIM relies on third-party providers such as Stripe, Twilio, AWS, telecom carriers, analytics platforms, and AI infrastructure. AIM is not responsible for outages, errors, data loss, delays, or failures caused by third parties.
Updates to Agreement
AIM may update this Agreement at any time. Continued use constitutes acceptance of modifications.
Governing Law and Venue
This Agreement is governed by Florida law. All disputes must be brought exclusively in courts located in Orange County, Florida within the jurisdiction of Florida’s Fifth District. The Account consents to personal jurisdiction and waives objections to venue.

Entire Agreement
This Agreement constitutes the complete agreement and supersedes all prior agreements or understandings.
Acceptance
By creating an Account, logging in, adding a Payment Method, submitting payment, or using AIM, the Account agrees to be bound by this Agreement.
